  "dochtmlcon": "<div class=TRS_Editor><div class=\"TRS_PreAppend\" style=\"overflow-x: hidden; word-break: break-all\"><span style=\"font-size: 11.5pt; font-family: 宋体; color: black; letter-spacing: 0.75pt\">\n<p style=\"line-height: 200%\"><span style=\"font-size: 16.5pt; font-family: 仿宋; color: #707070; line-height: 200%\"><font face=\"宋体\" style=\"font-size: 14pt; line-height: 150%\">&nbsp;&nbsp;&nbsp; 随着信息技术的发展<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">,<\/span>越来越多的新程序影响着我们的生活，“<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">QQ<\/span>机器人”便是其中之一。该程序可以自动完成自动对话、自动踢人、群内互动等指令任务，功能繁多，非常实用。可就是这个看起来无害的小程序，有人却从中发现了“商机”。日前，由诸暨市人民检察院提起公诉的叶某利用“<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">QQ<\/span>机器人”传播淫秽物品牟利案一审获判。<\/font><\/span><\/p>\n<p style=\"line-height: 200%\"><span style=\"font-size: 16.5pt; font-family: 仿宋; color: #707070; line-height: 200%\"><font face=\"宋体\" style=\"font-size: 14pt; line-height: 150%\">　　<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">2016<\/span>年<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">8<\/span>月，广东籍男子叶某在网上看到有人贩卖可以自动发出淫秽视频的“<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">QQ<\/span>机器人”，不用自己寻找片源，每月只需十几块钱，就可以由机器人自动发片。“那会就觉得这个赚钱好像挺容易的，也没想这么多，就想着可以赚点零花钱。”之后，叶某创建了一个<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">QQ<\/span>群，拉了群成员<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">500<\/span>余人。之后在某网络购物平台以<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">13<\/span>元的价格买下了名为“自动发片机器人，自动发福利，售后稳定”的 “<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">QQ<\/span>发片机器人”。通过设置，该机器人每分钟便会自动在群中发出一部淫秽视频。叶某在群公告中规定，群成员须支付<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">10<\/span>元可以成为永久会员，否则将被踢出。这之后，叶某的<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">QQ<\/span>红包财源滚滚。<\/font><\/span><\/p>\n<p style=\"line-height: 200%\"><span style=\"font-size: 16.5pt; font-family: 仿宋; color: #707070; line-height: 200%\"><font face=\"宋体\" style=\"font-size: 14pt; line-height: 150%\">　　不过，叶某的生意并没有长久。<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">2016<\/span>年<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">11<\/span>月，叶某被公安机关抓获。群聊天记录中的视频数量巨大，公安机关提取最近部分进行鉴定，就发现淫秽视频<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">264<\/span>部。<\/font><\/span><\/p>\n<p style=\"line-height: 200%\"><span style=\"font-size: 16.5pt; font-family: 仿宋; color: #707070; line-height: 200%\"><font face=\"宋体\" style=\"font-size: 14pt; line-height: 150%\">　　叶某利用互联网建立和管理主要用于传播淫秽物品的群组，并在群中传播淫秽视频牟利，情节严重，以传播淫秽物品牟利罪判处有期徒刑五年，并处罚金。提供该机器人的网络店主也已被公安机关抓获，正在侦查中。<\/font><\/span><\/p>\n<p style=\"line-height: 200%\"><span style=\"font-size: 16.5pt; font-family: 仿宋; color: #707070; line-height: 200%\"><font face=\"宋体\" style=\"font-size: 14pt; line-height: 150%\">　　《刑法》明确规定：以牟利为目的，制作、复制、出版、贩卖、传播淫秽物品的，处三年以下有期徒刑、拘役或者管制，并处罚金；情节严重的，处三年以上十年以下有期徒刑，并处罚金；情节特别严重的，处十年以上有期徒刑或者无期徒刑，并处罚金或者没收财产。同时，即使本案中的叶某不收<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">10<\/span>元“会员费”，免费发放，也同样构成传播淫秽物品罪。<\/font><\/span><\/p>\n<span style=\"font-size: 16.5pt; font-family: 仿宋; color: #707070\"><font face=\"宋体\" style=\"font-size: 14pt; line-height: 150%\">　　检察官提醒广大网友，通过<span lang=\"EN-US\" style=\"font-size: 14pt; line-height: 150%\">QQ<\/span>、微信等通讯工具向他人发送淫秽视频，与在网站、论坛上发布淫秽信息一样，均是违法行为。对于淫秽色情的网络信息，希望大家做到不点击、不下载、不传播，还网络环境一片净土。<\/font><\/span><\/span><\/div><\/div>",
